Questions re EU1 form

Hi,

Im an Irish citizen and have recently go married. My husband is non-eu and we are looking for any information that we can get on applying for residence for him.

He had a work visa in Ireland for 3 years but it had run out by the time we got married. Now becaue they are planning on deporting some non eu spouses we are getting a bit worried.

We are also expecting our first child in November so if he happens to be deported I wont even be able to go with him straight away. If there is anyone out there that could give me a little bit more information on what the EU1 form is all about and also the best way to go about applying for residence for him I would be really grateful.

We were only told to send a letter to the DOJ but were told nothing about sending an official form

The E.U1 form is for couples where one spouse is European ie Non Irish and the other is Non European. In case of Irish citizens, the proceedure is governed by Irish law and it is INIS which is the primary agency dealing with your application.

Ok that explains why we were never told about it. I really should have kept more upto date with what happens when you marry someone who is Non EU.

Don't worry about that! Most of us don't think of lawyers and courts when we decide to get married!

The EU1 form is for non Irish this is the first I heard of this! I thought if you are Irish but you have been exercising you EU treaty rights...in another member state you could use the EU1 form on your return to Ireland?

If that is the case, then yes you can apply for your spouse to remain under EU law using form EU1. (the Singh rule) But, if you are Irish, and living in Ireland, and want to apply for your spouse to join you or remain then EU1 would not be the appropriate form.
