ILR on HSMP

If you apply for ILR after 5 years on HSMP and you have still have 2 more years left on your last extension and your ILR is rejected, does your extension stay in force?? or do they reevaluate you on HSMP?

Well to my knowledge yes your HSMP should be valid even if you are refused ILR

HO cannot revoke HSMP leave (yet), so even after failing ILR you could stay and apply again if you wish.

Are you worried about getting ILR? It should be much easier than FLR-HSMP. No points and it's possible even without employment.

Of course you will have to read that 'life in the UK' book. There will be a test, so pay attention.

Why do you think its easier? They just evaluate different things don't they? Yes the stupid HSMP points is a pain thats for sure so very glad I am out of that phase.

Ya, much easier. No other way to see it unless you were out of the country for more than six months.

HO will only want you to prove that you have been in the country legally under a settlement visa and that you did not break conditions of that visa during the 5 years.

You will have to prove sufficient funds etc. Have a look at the ILR application. Only one page and very basic. You will be lumped in with spouses of UK people etc.

I think HSMP people have been so beat up that they will be surprised when ILR finally arrives and it's easy.

No, not yet. Will be eligeable for ILR next year, but have leave under HSMP through 2010.

There's so much bad news and uncertainty for HSMP around the changes next year. Wanted to be share a bit of good news with our friend SYH.

So let me get this straight, you basically can get approved with crap earnings in the final year and a healthy bank balance as long as you were on HSMP for 5 years.
