Tier 2 ICT to Tier 2 General

Hello There,

I am currently in UK on Tier 2 ICT Long Term Staff - Dependent and I hold a VISA till Aug 2015.
I am currently working in UK and to take care of my child, I have an contract with employer where I can work full time for 6 months and part-time/work from home for 6 months. Currently my employer is also willing to sponsor an independent T2 General VISA.

I understand that I have to travel back to home country and apply a new T2 G VISA with a CoS.

However, I have couple of doubts like minimum working hours/week, minimum salary, can UKBA Cos support the above model of working 6 months full time, 6 months part-time/work from home?

Hello There (Advisers),

I have a child and looking forward to work fulltime for 6 months and work partime for 6 months.

Could you please let me know if a T2G has any limitations/restrictions on the flexible working hours or something?

When did you apply for your entry clearance?

You may not be eligible for T2G. If you apply for a new entry clearance, you will be subject to 12 month cooling off period.

There are strict salary requirements, and I do not think it would be allowed to vary from month to month in the way you envision. Your salary needs to meet or exceed the SoC code, which cannot always be pro-rated.

The current VISA "Tier 2 ICT Long Term Staff - Partner" was issued from outside UK starting from Jan 2014 to Aug 2015.

Does switch from "T2 ICT-Partner" to "T2G" also needs 12 months cooling off? I believed that dependent to T2G didn't have to go through the cooling off. - Please advise.

Sorry I must have missed the part where you are the dependent. You would be exempt from the 12 month cooling off period.

Tier 2 visas are not really designed for flexible working patterns. You would need to be paid the same consistent salary which would need to meet the requirements of the Codes of Practise.

I am going through lot of immigration changes this year and looking forward for some support and advice.
Just another query:
1) Is it possible to switch from T2G - Dependent/partner to T2G. While converting from T2G - Dependent to T2G, do we need to apply from outside UK or can be done in-country?

2) Is it possible to switch from T2 ICT Long term to T2G - Partner/Dependent in-country?
