Regarding dependants travel abroad when visa expired

Post by rowthrinath » Mon Nov 24, 2014 2:25 pm

Hello,

I am in UK and I have an extension under the Tier1 general category on April 2015. My wife is with me in the UK since August 2012 and her visa as a Tier1 dependent also expires by April 2015. She is pregnant and will be travelling to India by April 2015. She will be in India till December 2015 or till she intends to stay.

Question 1: Can I not apply for her till December 2015 and ask her to apply for dependent visa when she intends to travel?

Question 2: I will be completing my 5 years in UK by December 2015 and then apply for my ILR; will my wife be able to apply for ILR with me by December 2015? Will question 1 have any effect on her ILR processing?
