What can I do after ages of waiting?

Post by KingNothing » Wed Dec 03, 2014 7:09 pm

Dear All,

I have got an awkward situation:
1- I applied on December 2012 for Tier 1 Entrepreneur while the rules had not been changed
2- I received a letter on February that the rules will change soon and they will communicate with me.
3- In March 2013 Application was refused on 3 points.
I) Bank letter does not contain third party landline number
II) Third Party letter is not signed by applicant
III) No declaration letter was available from third party legal representative
4- I got a right to appeal so I appealed. My hearing was in January 2014
5- In FTT Court we discussed that on I) phone number was available from application form / on II) we approved that it was missed but it was missing information, based on Rodriguez, Evidential Flexibility (Valid at time of decision) and Immigration Rules 522A, Home Office had to ask for missing information / on III) Letter was available in wrong format and Home Office had to ask for correction.
6- Judge allowed the appeal and in determination said that Home Office has made unlawful decision and now based on Judge points raised (rephrasing of points raised by us) Home Office should make lawful decision. Determination was on February 2014
7- Home Office applied for UTT to challenge the decision because of Err in law in February
8- Home Office application was refused by FTT as all points were clear and lawful
9- No News from Home Office From March until November 2014. Call were not responded clearly
10- I made a contact to my MP and 2 days later home office sent a letter
11- Home Office asked for fresh Third Party declaration of funds signed by legal representative and me ...
12- My third party was overseas... I had given originally 7 days to make it and 3 days were passed when I received a letter. Using family overseas and wonderful Express post services, I managed to get the letter and sign it by both our legal representatives here in London for me and overseas for my third party as well as their own letters stating that they have seen us signing the letters. All letters are following Home Office format and I really believe letters were spotless. I asked my barriester to double check it before submission of letter so it should be fine.

13- Now it is 14 days I have sent the letter to case worker using the TAG Address they provided... I checked royal mail special delivery and they received it on time...

My question is WHAT NEXT?? Again no news from home office... Can Home Office keep on going on and going on this never ending story???

I appreciate your comments specially experienced people like Olasunkanmi who helped me in past during these 2 years of blurry days...

Any Ideas anyone?? Does that mean no one ever faced this situation??
Shall I go ahead with MP again? Shall I go for JR? Shall I wait more??

if you disregard the rules in place at the time of your application in terms of time lines ,time to make a decision is 8 weeks unless told, the day you supplied a document that they wanted clock started ticking down, this means if you do not back hear from UKVI in 8 weeks you should again contact your MP. first Good thing that MP's office does is to ask UKVI on the basis of time that they initially say thy deal with an application within.

its always worthwhile approaching or returning to MP for such delays

in addition to above make sure you stay active in providing business services, you never know if they could ask you to provide evidence for business activities.
thanks,
