EEA REFUSAL URGENT HELP

Post by memphis86 » Thu Dec 04, 2014 12:07 pm

Hello Everyone,
I need an urgent response concerning my EEA2 application, below is my timeline:

APPLICATION SENT : 3 JULY 2014
COA RECIEVED :16 JULY 2014
INTERVIEW REQUEST :29 TH OCTOBER 2014
EEA2 REFUSED :03 DECEMBER 2014

At the innitial time of application my spouse EU national was excersising her treaty right but the contract got terminated in august and during the interview my spouse was asked if she was currently working and she explained the situation to the interviewer.
Today i have received the refusal notice stating that although the UKBA are convinced that my relationship with my spouse is 100 % geniune ,they have refused my application on the basis that my spouse is not excersinig treaty rights.
Now this is where i need advise.Since we got back from the interview on 29th october 2014 my spouse has since returned back to work on 3rd of novemeber.
1) DO I SEND HER RECENT PAYSLIP AND LETTER FROM HER NEW EMPLOYER ASKING THE UKBA TO RECONSIDER APPLICATION ON BASIS THAT SHE HAS RETURNED TO WORK
OR
SHOULD WE PROCEED WITH THE APPEAL

Thanks all for your expected replies

You can do both and see which one comes successful.

If your wife cease work, that does not mean she cease to be a qualified person.
