Family visit visa & OCI

Post by gsa09 » Mon Dec 01, 2014 2:51 pm

Hi,
Could you please advise on the following queries?

Family visit visa:
* Soon I'm planning to apply Family Visit visa for my parents. I'm living in a single bed room house with my family (wife and a kid) in a single bed room house. Thought it is small to accommodate my parents, due to financial reasons and also school catchment reasons I don't want to move out of this house or to a bigger house just for couple of months of my parents stay.

My query is, will the visa approval officer object or reject visa for my parents due to this reason (insufficient accommodation)? Appreciate your kind advices.

OCI query:
* Do I need to copy and send all pages of the cancelled passport? or just the first and last pages?
* I have an expired cancelled passport, do I need to include its copies as well? If yes, is it just first and last pages or full passport or full passport?

Many thanks.

Family visit -

329 Exception; visiting member of family.
Where the persons sleeping in an overcrowded dwelling include a member of the occupier’s family who does not live there but is sleeping there temporarily, the occupier is not guilty of an offence under section 327 (occupier causing or permitting overcrowding) unless the circumstances are such that he would be so guilty if that member of his family were not sleeping there.

OCI -
No and No
Only surrender certificate is required.

Hi ban,

I read 327, 328 & 329. It was a bit hard for me to understand it completely. Kindly correct me if the following is wrong.

My child age is 4. In the house there are two rooms of moderate size. We three can sleep in one room and my parents can sleep in the other room without any problem. So, my understanding is 'it is lawfully allowed and acceptable to invite my parents to visit us as it is just a temporary family visit (6 months).

I believe it should be ok as the visit is of temporary nature.
