I Received A Notice Of Receipt For Permission To Appeal To U

Post by NAZH » Sat Dec 06, 2014 10:56 am

I got letter this morning containing NOTICE OF RECEIPT for permission to appeal to Upper Tribunal but the funny thing is I have had no decision/determination letter from Home Office or my solicitor.

My case was heard at First Tier Tribunal on the 4th of November and we have being waiting for decision letter ever since. It is a Saturday so I have not been able to contact my solicitor but I doubt if a solicitor would apply for permission without the consent of client.

I just want to know
- if it is possible for HO to apply for permission to appeal without sending out decision letter.
- if it is possible for HO to withhold a decision and then apply for permission without notifying the applicant.
- if the court sends out decision to HO alone or to applicant as well.
- who is appellant on notice of appeal because my states I am the appellant but I have not apply for any permission.

I hope someone have seen a case like this before.

Speak to your solicitor , or better still, speak to the Tribunal directly.

I don't think there will be an application for permission to appeal , if there was no decision.

I believe there had been a decision , and home office has appealed it.
