some advice please!

I have been in uk for last 11 years with the last year on ILR (based on long stay...ie..10 years).

My wife and 2 children aged <17 ( both born in india) are currently on dependant visa... when i was given ILR last year.

I & my wife have both completed life in UK test.

My wife and children have been here with me since 2002.

Could you tell me the naturalisation procedures for I , my wife & children please. ...what is the sequence of applying ?

Your answers would be much appreciated.

Assuming that they switched to being your dependents when you were granted ILR, they will have to wait until two years after this approval to get their ILR.

I guess you should read the post a bit before asking the questions my friend. :roll: :wink:

They cannot have ILR until their second anniversary on the dependant visa and both children are 17 according to the post.

I guess they would have to apply on their own merits since they would be both 18 years when they apply for naturalisation (unless of course they are still dependant on their parents).

I think it is the case that strictly they don't have dependent visas, they have a 2-year spouse visa and a 2-year child settlement visas.

In the last 28 days of those 2-year visas an application should be made on form SET(M) to convert all of those visas to ILR.

Naturalisation! Assuming you want this all to happen as soon as possible, you should apply for Naturalisation as soon as you have had your ILR for one year. You will use your pass certificate from the Citizenship Test when making that application.

Naturalisation application for your wife? Registration applications for the children? By the way, how old are the children now? Once you have your British Citizenship, surprise surprise, your wife will be married to a British Citizen! Accordingly on the latter of you getting your British Citizenship or your wife getting her ILR, she can make an application for her Naturalisation, given that the normal one year waiting time will not apply to her ..... because she will be married to a British Citizen!

But if you want to wait and submit the Naturalisation applications together, you will need to wait until your wife has had her ILR for one year.

If following my naturalisation , does the children & wife still have to change to ILR & then wait for one year on ILR before applying for naturalisation?

:roll: :lol: I should read the posts carefully? They are under 17 (<17), which is why I asked their precise age. I asked him because I thought that (young) children could apply for ILR immediately? Even if they just arrived?

And I didn't understand his timeline..."when I was given ILR...".. he wrote that they came here in 2002, so why don't they have ILR if they were on a dependent's visa? Is it the 10-year rule?

Yes, that is the case. By itself you becoming a BC does not change your family's immigration status. But it would allow your wife to apply for Naturalisation immediately after she gets her ILR, rather than having to wait one year.

Is anyone going to mention the PPRON method here? Given that we are talking not just about the wife, but also two young children, would the PPRON method work?
I asked him because I thought that (young) children could apply for ILR immediately? Even if they just arrived?
The simple answer to that is no! What gave you that idea?

I know where I'm confused! Is it when the parent is a BC and they bring over a child under 16? I'm sure I read it somewhere on this board, where the guy bought his kids over (one was 16, the other under 16) and the younger one could could apply immediately (for BC) but the 16 yo could not?? Anything like that?

Plus, I didn't remember the child settlement visa...

It is possible that once someone gets ILR they can apply for ILR for minor children. It is discretionary, but possible.

So the plan should be i apply for BC.
Once successful apply for wifes ILR.
This much is clearto me.

But what about children....

Do they continue on present visa or can they apply for ILR?

thankyou for replying to my posts earlier
could i just clarify a few doubts because i seem to be getting conflicting messages.
i applied for naturalisation and received favourable replyfrom the homeoffice .
I was then invited for citizenship ceremony which is planned for the 31st of october.

My wife & children have been continuosly resident here since 2003 & they are on 2 year dependant visa when i got my ILR on sept 2006.

Questions?

Can i apply for my wifes ILR after the 31st october or is it only after receiving a british passport?
