Refused VISA - Appeal

Post by MilleniumDK » Thu Oct 16, 2014 3:31 pm

Hi

Just been refused a fiance visa, I believe I have good reason to appeal as the totally ignored the financial requirements rules for funds and investments

Anyway my question is, what is the best way to do it, If we do it online do we have to still send in a copy of the refusal decision?

Also I want to reattach the bank statements they appear to have ignored.

If I have to do that is it best just to do the paper version and send it with the documents?

Thanks in advance

Oon't think 'investments' count do they? Only liquid funds?

Providing you liquidate them before the application - they do. It's a bit like property in that respect.

However, the previous posts from OP reveal just how confusing that section is.

OP - can you please post the text of the refusal and we can help you assess it.

I know they have got it totally wrong

I liquidated my assets just before application so my account went from £0 to £35K overnight 1 week before the application (I had 30K cash in another account aswell). The ECO refused on that £0 being my account balance within the 6 months. I included valuation reports, buys and sells for 10 months.

I know they are wrong, I also put in a big explanation in the cover letter for them to see how it was done, it was clearly not even read as there has been no attempt to understand it my finances.

Anyway the question is more about the appeal, whats the best way, do I need to re send all my statements, I have referred to them in my explanation. If so is it better just to do it all by post as I will need to send the documents off anyway as well as the refusal letter. It says doing it online will speed it up?

You need to do the appeal on line within 28 days.

You will need to serve a bundle containing the documents you are relying on and the law.

The Home office will also send a bundle to you aswell.

Hi

Its been a while.

The good news is the appeal was successful, delighted!

One final issue, since the appeal went in, my partner has had to apply for a new Colombian passport, she now has two, she needed to apply as the US visa is in her old one and we are going there for xmas (You need a biometric one now).

What happens now? Will they issue her visa in her new passport? She has the old one as she needs it for the US visa (i.e. travel with 2 passports)

Thanks
