Tier 2 - Employment Start Date (Switching)

Post by immee » Mon Dec 08, 2014 10:49 pm

Hi All,

I need an advice by the expert members of this forums and any help would be highly appreciated.

Switched from Tier 1 Entrepreneur to Tier 2 General:

I applied for a Tier 02 general visa at PEO office on 10 September 2013, my employment start date mentioned on COS was 12 September 2013. For some reasons PEO holded my documents and i did not received my Visa and Passport back until 23rd of September (Although the visa issue date on biometric card is 16th september) . While i was waiting for the passport, my father suffered with a minor heart attack (In Dubai) so i had to travel soon after i received my passport back, i travelled on 24th and came back on 8th October. It was then agreed with the employer that the employment start date now would be from 10th October 2013...

I was already in the UK before i applied to switch from T1 Entrepreneur to T2 General but looking at above scenario and looking at UKBA/HO rules, which says "Your stay must start no more than 14 days before the start date on your certificate of sponsorship" .. Do you think anything is gone wrong in above case scenario ?

I only realise it when i am trying to apply for my wife's visa who is in Dubai at the moment and one of the question in the application form is "Employment start Date", Now my question is if my actual employment start date is different then what is mentioned on the COS and with the above 14 Days rule, i am not sure what to do in the above case ?...

What employment start date should i put and if i put 10th of October, then would that be an issue ??
