Curtailment letter not yet received

Post by ravisb_2014 » Mon Dec 01, 2014 9:22 pm

Hi,
I am Tier 2(G) and visa is valid till 2017. My employer made me redundant in the month of October mid, 2014 and they informed the same to home office. But till now, I have not received any letter from them yet. It's already 1 and 1/2 months. My query is -
1. Do I need to wait for letter ?
Or
2. Contact home office directly or email ?
Or
3. Is there any other source I can come to know about my curtailment on my visa ?
Expert, Please suggest. Thanks in advance.

there is nothing to worry about. Hopefully, the UKVI has your current address, which should have been provided to them by your employer at the time of informing the curtailment.
It is not uncommon for the curtailment letter to arrive late, sometimes many months.
Your curtailment of leave will start from the date you receive the letter to 60 days. So if between that time u can apply a new visa with new employer, you should be fine

Thanks iworker for valuable suggestion.
I am actually expecting CoS to be assigned by my new employer by next week as RLMT is going to over soon.
i think immediately on the next day of 28 days of RLMT, my employer can assign the CoS in my name ? am i correct ?
How long will it take to get it generated or created by HO ?
After generation of CoS, can i apply for Visa immediately ?
Please suggest.

While the RLMT is being conducted, ask the prospective employer to request for cos allocation if they dont have 1 already.
Requesting and granting of cos can take from couple of days to few weeks.
If they already have a cos allocation, it will take half an hour to assign it to you.

Thanks Iworker.
I already discussed about cos with HR. As per HR, it seems they already have one unrestricted cos allotted to them, when they applied for sponsorship. Does it show in SMS ? I am not sure about that.
I am in UK, so I need unrestricted cos only. I have some more queries about what is the procedure for applying for VISA after cos being assigned. I will go through the guidelines first and if I have any query, will open a different thread for the same. Thanks you so much for your help.

I have a quick query on correct SOC code.
My new employer has posted the job requirement and given the job description something like as below.

Developer role (as title) that includes (job description) design, development of software and written that following
will be the reponsibility -
Liase with internal/external customer, design, development, work with project team and
participate in testing, review of design and code review.
and after that list of skill sets, experience and qualification required.

I can see two SOC codes that are closely matching with the requirement, both almost 50%.
2135 - says -> liaises with internal/external clients in order to analyse business procedure
...
2136 - says -> undertakes feasibility study to design software solutions; and other writing code and testing.
...

It's better if my current employer gives SOC code as 2136 as I am working as a developer, not
currently involved in design and requirement gathering from customer. But worrying
if home office (HO) rejects it as it's 50% matching with 2135 too. Could you please suggest which SOC to select
for this role and as SOC is decided by employer, i can request employer to use 2136 SOC Code and if
HO questions them, they should be able to prove the same. Please suggest..

yes the cos allocation does show in SMS so if the HR is saying so, then it must be the case.
The SOC code is responsibility of employer and u should/would have no say in it. Dont be too much worried about it, i think u should be fine with either code.

Thanks iworker for your quick response. Appreciate your help.
Actually my employer was not aware of sponsor or RLMT or SOC code or COS initially. From the beginning, with the help of this group and going through the Tier 2 guidelines, I am trying to guide them (indirectly helping me to get sponsor). So, when they asked me about SOC code, I am just confused which one to suggest. I will ask them to use SOC code as "2136", that is kind of programmer or developer role. I hope HO will not reject it by comparing with job description as it's a mix of development, as well as design and requirement gathering from customer, but real work is going to be development and maintaining of software product. As you suggested not to worry about it, I will suggest them to use 2136. Thanks again for your suggestion and this group.

Re: Can I apply for ILR ?

Post by bisu68 » Tue Dec 09, 2014 2:05 am

Hello , I first came to the UK as a student ( accompanied by my wife ) in 2002. Since then I have managed to maintain a lawful ( legal ) stay either by extension while still in the UK or by going back to my country and applying for a new student visa. My last student visa granted in 2010 as tier 4 general student until January 2015. I had to defer my studies to 2011 but unfortuanatelly an uprising and then a war errupted in my country. This has prevented me from enrolling in September 2011 because I was in my country back then. In late 2011 I came back to the UK but because the old system in my country has collapsed, my governmental finances of my studies have ceased accordingly. The situation overall was terrible and messy and my studies was completely stopped. I carried my life normally in the UK travelling outside and coming back with my current tier 4 visa swiftly without any problems at the airports immigration check. Recently I went to applying for settlement as long residency but on pulling my records from the home office, I found that my old CAS has expired and my leave to remain as a tier 4 was curtailed to August 2011. The final decision in my Home office record states ( Curtailment Not Pursued ). I have never recieved any notification of this curtailment either by email or by post. My email & postal address were updated with the university. The question is How could I & my wife and 4 kids were able to travel outside the UK and back to the UK beyond 2011 without a single stop or detention from the immigration office?(our last entry was in September 2014). Also, how can I deal with this situation ? Am I considered in breach of the UK immigration rules as overstayer or what ? ( PS: All my 4 kids were born in the UK. The eldest one is 11 years old )
Thank you
