Parental Responsibility

Hello, I am living in UK as an unmarried partner of British Citizen(got 30 months visa). I have 1 kid living living with me from previous relationship who started living with me from Dec 2012. I need to apply for his dependent visa, i wonder if someone could help and tell me what application form should i fill in for his visa as my dependent.

Secondly i need to know if i need to get Parental responsibility officially or i have have that automatically since my name is on his birth certificate along with her mother. It is important to tell that i mentioned my son as my dependent when i filled my application for unmarried partner back in Dec 2013 but i did not apply for his visa at that time since i did not have his passport with me.

Any help and support in the matter will be much appreciated !!! THXXXX

The first hurdle you will need to overcome , is to show that you have sole responsibility of your son.

If you are unable to show sole responsibility, and that the mother is either dead or plays no role in his/her life, then there is very little prospect of a successful application of that sort.

Thanks for your help. I wonder if you could tell me that how can I show sole responsibly in my situation. My name on his birth certificate as father he is living with me for the past 2 years. In our divorce application it was written that the son will live with me. What else do I need in papers plz help .

Secondly which application should I fill in (flro-flrm-flrfp) plz advice regards

As well as mother will contribute towards the expense of the child when she will get a job( Even though it has not happened so far).

Since the child is living with you in the UK since 2012, what is the child's current visa/immigration status??

Apparently child does not have valid leave to remain. His passport is still with the home office as part of visa application sent by his mother, but somehow Home office has still got the documents but they never issued him visa. I do not know what the problem is but thats what it is.

since child is living with me after divorce as per the child arrangement agreement, i need to apply for his visa.

Did child make an valid application for further leave to remain prior to expiry of leave? If so, then when was the application made? What application was made?

I am pretty much sure that child's application was made in time but don't what application was made though. His mother was student at that time,most probably student dependent application would have been made.

Form FLR(FP) may be the appropriate form.

Does you and your wife earn 22,400 a year.

Slightly complex application, but i suspect your child may qualify under E-LTRC .

thanks for response!! My partner claims carers allowance , i think we are exempt financial threshold. We did show all the dwp letters when applied for my visa recently. My concern was just to make sure that i have Parental responsibility which i certainly(kids are living with me since 2012, divorce documents does mention that kids will be living the father, my name is on kids birth certificates and passports as father)have but as far as the documents are concerned, i wanted to know the type of documents i need to attach with the application form apart from the ones i have.

an advice on the case will be much appreciated !!!!

Please also note that we offer our time and advice for free and we also have family and work like other people and if someone is not responding to you, perhaps it is because it is either a bit complex or they are busy.

Behaviours like this will put everyone of. It demonstrates this false sense of entitlement to be responded to, which is just non-existent.

no one can deny to appreciate the fact of being helped on this forum, but somehow i felt ignored on purpose...being a new user i do not know the protocols of the forum. But it does not necessarily mean that i am not obliged to help being offered. I hope you could understand the reason behind my last post. There is no doubt in it that i find this forum allot helpful than others never the less we can not deny the fact that there are long delays in response and help being provided. Its just is my opinion... I am still obliged and thankful to all the users who posted to help me .
