permanent residence application

Post by tekaafanu » Thu Dec 11, 2014 5:59 pm

I am a newbie in this forum and will like to seek help from every member of this forum,i was married to an italian lady in november 2009 and applied for residence card which was issued april 2010 .Things got bitter between me and my wife in 2013 and we couldn't resolve it so we got divorced and i made an application to the homeoffice for retention of right which was refused on the grounds that some documents are missing. ex wife was self employed which i provided all the tax statement and ni payment from 2009 till the date of divorce,i also provided an accountant's letter but homeoffice refused, i appealed and a judge allowed my appeal based on those documents and since there was evidence of tax being paid so i qualify for retention of right ,Homeoffice did not appeal the decision, a new 5 yrs residence card was issued but this november i already qualify for permanent residence and will like to make an application for it but i am confused. since i retained my right of residence and i am planning to submit a hmrc employment history which covers period of selfemployment till divorce date, please advise if the employment letter from hmrc for my ex wife is a good prove that she worked for all those period and will allow me successfully get my permanent residence. please your advise is needed.

It all depends on the nature of your case.

You will need to provide evidence that all through your marriage and until divorce she was indeed a qualified person, and that following your divorce, you have been working.

It depends on the quality of the document that you have, which i am unable to comment on, as i have not seen it or which it seeks to demonstrate.
