Post by nammu » Wed Sep 05, 2007 8:52 pm

Hi ,

can anybody clarify, I have got my ILR and want to know can I apply for child benefit and tax credit.

Is there any official statement to refer or wbsite which gives more info on this.

Hi yes, you are now free to apply for public funds.

If you go to http://www.hmrc.gov.uk/childbenefit/claim-info.htm download the form, in the notes it explains that ILR means we are not "subject to immigration control" therefore eligible for Child Benefit (and Tax Credits).

As already said, yes indeed. But do you also have born-outside-the-UK children, now in the UK with you? If so do note that they cannot yet be registered as British, not until you seek your Naturalisation, and as the fee for submitting form(s) MN1 for child registration is currently £400 .... for one or more such forms submitted at the same time ..... it would be more economic to wait so that all the forms MN1 are submitted at the same time.

As mentioned by others, yes. Although you have to be aware of your own country citizenship rules for dual nationality.

Sorry, that is still potentially ambiguous!

How many children do you have in total? If just one then no harm in proceeding to submit the form MN1 for that one child, now that you have your ILR.

Dual nationality? You have clearly considered the impact of the child's BC on their Indian citizenship.
