Student Visa-> PSW-> Tier2-> Child born UK-> T2 expiring->??

Post by monky123 » Tue Dec 16, 2014 11:35 am

I have been legally living in UK since Aug 2008 (6+ years). I have 1+ year old child born in UK and currently working in IT on T2 Visa

Timeline.
Aug 2008 -> Student Visa
Feb 2010 -> PSW Visa (start working in IT)
January 2012 -> Tier 2 Visa (continue working in IT)
April 2012 -> family reunion (spouse and children joined me in UK on depended visa)
Sep 2013 -> child born in UK
January 2015 -> Tier 2 visa expiring

Tier 2 extension from same company is not possible because of current company financial and legal conditions.
Finding another sponsor is kind of impossible because of labor market test restriction and limited companies registered as sponsored

There are many jobs in my fields, few of them even hired me but once knew I require tier 2, they apologized

Is there any legal way/option to continue staying in UK? I have very good family and friends social circle in UK - going back means starting all over again.

If there is any legal way, It worth spending money to hire a solicitor else it pointless to waste money.

Any help/guidance will be appreciated.

Do you have vast wealth - would T1 entrepreneur be a route for you?

Otherwise, your only real options are:
T2
T4
Spouse (but I assume you might already be married to another non-EU citizen who is the other parent of your child).

Otherwise, starting over might not be as bad as you think? The UK is trying to get rid of immigrants. Look at other EU countries. Denmark, I hear has something like the old Tier 1 General.
