Naturalisation application for Unmarried partners

Post by Dangerfell » Fri Jan 02, 2015 12:58 pm

Hello, hoping you can help.

My Question is: If I got my indefinite leave to remain through an unmarried partner visa can I apply for Naturalisation immediately? The form AN only speaks about Spouses or Civil partners.

Background: I am currently on an unmarried spousal visa. In a few days I will apply for my Indefinite Leave to remain and pay for the same day application turnaround, can I apply for Naturalisation immediately?

Thank you

No. Section 6(1) is applicable.

Thanks Vinny,

1. So to clarify I have to wait a year before I apply for my indefinite leave to remain? I find this confusing as unmarried partners are classified as being in a relationship akin to marriage.

2. What are immigration time restrictions?

3. I have been in the country for more than 5 years, could I apply immediately and state that there are special circumstances?.

You have to have been on ILR for a year before applying for naturalisation if not a spouse.

1. Not for ILR if you qualify now. Yes for naturalisation.

2. Not sure what you mean

3. No.

Hi Wanderer,

For my question 2 I am talking about:

Section 6(1) of the British Nationality Act 1981

4. You must be free of immigration time restrictions on the date of application, and have been free of immigration time restrictions for the twelve month period before making the application (see the section on Immigration Time Restrictions).

Basically says what I said above, when you apply for naturalisation you must be free of immigration control (i.e. on ILR) and have been for the 12 months previously.

And also have been physically present in the UK five years to the day from date of application.
