Dependant Visa

Post by firestar » Mon Jan 05, 2015 11:51 pm

Hello,

I got my ILR (via Tier 1 General in September 2013) and my fiancé is currently in the UK on a student visa (since August 2014). We will be getting married in the UK in June. We want to apply for a dependant visa for him following the wedding. What visa category should we apply under? I am getting confused by the many different options available for dependants.

Many thanks for your help in advance!

FLR(M), if her student leave was granted for over six months duration and all the other requirements of Appendix FM are satisfied.

Many thanks for your quick response Vinny.

The student visa was granted in August 2014 and is valid until January 2016.

I thought the FLR(M) was only for ILR applications for dependants? Is my fiancé eligible for ILR directly or would he have to wait 5 years in the UK before applying for that?

Your fiance isn't eligible for ILR until having spent 5 years, she will be given 2.5 years first under flr(m) and then apply for further 2.5 years to qualify for ILR.
You also need to meet financial requirement of 18600 and all other requirements.
What Vinny said is the right thing to do,just trying to break it down for you.
