Extension of DLR

Post by siliconegel » Wed Jan 14, 2015 9:41 pm

Hello everyone!! Happy New Year to you and we hope 2015 will be a good year for everyone. I am new this forum and my friend advised me to join his forum to get immigration advise.
I am confused as to which form to use for extension of DLR visas. Something about myself. I arrived to the UK in August 2008 on spouse visas. My marriage broke down in March 2010 as a result of domestic violence. My ex was charged for that. I applied for ILR in August 2010 and was refused as I had used the wrong form and I became a over stayer. I applied again with the right form but my visas had already expired by then. As visas had already expired, HO again refused my application. However I managed to get an appeal which I was won in court and was issued DLR valid for 3 years based on private life which expires in March 2015. Form FLR(FP) can be used based on private life for 10 years but I don't think it is this form as I have only lived in the UK for just over 6 years.
My circumstances are still the same. What form do I have to use to extension of DLR by another 3 years?
Thanking you all in advance.

You should be able to get ILR immediately.

Who ever advised has clearly given you a wrong advise.

You should not have had DLR.289A Clearly provides for ILR, and you clearly meet all the requirement of 289A, which does not include the requirement to have an extant leave, incidentally.

Obie, you are right that I should have got ILR, but because I had used the wrong form and by the time I submitted the correct application form , I was already an overstayer. Anyways after fighting with HO, they issued me DLR for 3 years based on old rules. The time to extend DLR by a further 3 years is coming soon and this time round, I want to make sure I use the correct application form. Could you please advise the correct application form for extending DLR based on private life (just over 6 years in the UK). My circumstances have not changed. I am working full time, paying taxes, not claimed any benefits so far.

Set (O) would have been the most appropriate form to use.

Obie, what form do i have to use now to extend DLR? Is it FLR (O), FLR (M) or FLR (FP)?
Thank you

It will be FLR (o), if you prefer the renewal route.

Thanks. Will be going for renewal route as I am not entitled to apply for ILR.
