I have a question about earning power.

I was previously (until Sep 2002) resident in the UK on a 3 year work permit in a permanent position as a Lead Software Developer.

My salary was UKP 49,500. This was well within above the earnings requirements to gain salary points for HSMP.

However, now that I am in Australia, my previous 12 months salary is far below the threshold to gain any points.

The question is, would the case workers consider my previous UK salary instead of my last 12 months Aus. salary - as I would be applying for the same kind of Software Developer positions on my return to the UK?

Or is it straight down the line/ by the books... Anyone know?

if you read in the guidance note you might find a conclusive answer there. but in my view, its only the last 12months which count, the other earnings you might have earned wont be considered. you can use the experience gained though, and depending on your position at work now you could get 50points and if you can find 15 points elsewhere then you will be okay

Case workers follow the guidance, I understand they will only accept your current australian income.
In some cases, for example students, they accept older income as the person is not currently working, but in your case your australian income will be considered.
Another option is if you are not resident in australia or just came back a few months ago, then one could argue that as you are not yet resident then they should accept the uk income...but you have been in OZ more than 10 months....
