Hi,

I am new to this forum and not sure whether anyone can help/advice me in this case.

I am a German national living in the UK for about 5 years, I am working part - time and I am a full time student. As I am planning to settle in the UK, I applied for a EEA family permit visa for my husband who is a french refugee. He got a 6 months visa issued on his French travel document and moved to UK in October 2014. We are in the process of applying for a residence permit when my Solicitor pointed out that we might have difficulties as he is a French refugee and he will get his residence permit issued in his French Travel document which is due to expire in June 2015.

Now, I am worried that when I send off his application for residence permit they might refuse it as his travel document is due to expire soon. Another issue, I heard according to French immigration rules apparently, if a refugee is out of country for more than 3 months, they won't issue him a new travel document (not sure whether this is true or not).

Is it true, that they issue him a residence permit in his current Travel Document or will he get a Residence Card and if so can he also apply for a UK travel document when he staying with me in the UK and not returning to France. What status will he get if he decides to stay in the UK? A UK refugee? or still French refugee?

I am zoo confused, not sure what to do and my Solicitor also has no idea about the French Refugee rules and regulations, etc. Please, anyone who had a similar situation or any advice????

I am not familiar with French immigration law especially relating to refugees but at least can say that if someone marries with an EU national then covered by EU directive and enjoys the privileges as a family member of EU national as long as have the genuine relation with EU national. And if he willing to stay in UK then better he should apply his national passport in order to proceed with eea2 RC application and the same eea2 rc can enable him to travel to/travel from France along with you freely. Otherwise he should comply with French immigration rules to maintain his application/status there.
