Post by yaakovnewman » Mon Jan 26, 2015 7:39 pm

Hi All
Need some information regarding my wife German residence card. I am a British national living in Hannover Germany since September 14 and working as free lancer for Vodafone I never thought to get settle here so I come and go as project requires but now due to nature of project I have to stay here for a year or two. My wife doesn't have British passport yet but she has one year Schengen visa and living with me here, my question is can I apply for her spouse visa while she stay with me here ?

Why should your wife apply for a visa if she is already in Germany. She should apply for a resident card (Aufenthaltskarte-EU) in Germany in the first 90 days.

Thanks for reply, by applying the visa i meant the resident card or what ever they called it here I went to Ausslanderbehode in December last year and there a lady advised me to get a Schengen visa for my wife as I m not sure for how long i stay in Germany plus the spouse visa for non eu passport holder take ages. She saw my papers and issued me a official invitation letter and she got one year Schengen visa from London
Now as I need to stay here for longer period of time I want to her to get some other visa status so i can add her in my medical insurance and stuff.
Hope this clear the situation
Thanks

If your wife want to stay longer than 90 days in a 180 days period she has to apply for a resident card at the Ausländerbehörde.
If you and your wife are moving into a own residence you and your wife have to register the address/residence at the Bürgerbüro in the first 7 days.
The address registration (Wohnsitzanmeldung) is one precondition for the resident card.
Adding your wife to your medical insurance should be working with the address registration alone.
