Is my visa category correct.

My wife is currently on ILR (June 2014- current), before she was on Tier 1 (since 2009)
I am on Tier 1 Dependent Visa (April 2014- April 2016) (second extension) issued from India and currently in the UK
My daughter is born in London, and but currently in India. She does not hold any UK visa.
Do I need to upgrade to a spouse visa to bring her in the UK. Can I be on Tier 1 Dependent visa and apply for
"Child or Other Dependant of Settled Person".

home office usually advise point based dependents to change their status according to their sponsor's status. Therefore, you need to apply as a spouse and you can add your child as a dependent. You must meet financial requirement though.

Thanks for your reply. Can I switch from Tier1 dependent to spouse visa within the UK and in same-day application service.

If your partner was in the UK on a temporary visa before settling or becoming a British citizen, you may have to apply as a ‘dependant’ (partner) in their original visa category.
