Post by firm » Wed Sep 10, 2014 9:33 pm

I got married to an Asian National. I have been working in UK under dependent visa.for past 3 years
divorce is completed & currently financial settlement is under progress. i am staying by myself.
Marriage tenure under 5 years

how long can i continue to stay in UK
Do i need to inform the Home department
Would there be any issue ,as i need to be in UK as long as my financial settlement is not over.

Your leave will likely be curtailed once they are informed that the relationship is not subsisting. Do you have children?

Is it possible to remarry after the divorce and switch into another spouse visa within the UK after getting divorce from the first husband and visa not having curtailed?

No.
Well, she is not on a visitor visa nor she has leave granted less than 6 months so I take it she shouldn't face any hurdle in switching in to another spouse visa in the UK itself. What is your basis of arriving at the conclusion that can switch into another spouse visa in the UK itself? Her ex husband didn't inform the Home Office and her visa is still valid until October 2015.

Can't switch 'cos visa is now invalid and she is an overstayer. As soon as she applies for another Spouse visa she'll most likely kick off the removal process.

I agree with Wanderer.
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
