ILR (LR) Travelling to Europe with British Spouse

Post by ratz » Mon Feb 02, 2015 2:03 pm

Hi All,

My ILR (LR) is currently pending and I believe I would get a successful outcome from it.

I'm married to a British National and we're thinking of making a few trips to Europe this year upon receiving my ILR (LR). Namely, France and Italy.

From the research i've done, I need to have the ' family member of an EU citizen ' clause on my ILR resident card in order to be able to move freely around Europe with my spouse. I submitted our marriage certificate with the ILR (LR) application but I am pretty sure the chances of them including the 'family member of an EU citizen ' clause on to my resident card is pretty slim as it's a completely different visa. Am I right in thinking this? Or should I write to them and ask them to include it if they can?

If I am unsuccessful with the above, are there any other ways to travel to Europe with my spouse without having to apply for a visa each time?, as the visa process can take at least an entire day. I have read about the EEA family permit, but I think this is not available for spouses of British Citizens?

I wonder if someone else amongst you have been in the same situation and have found a solution.

Thank you in advance.

Best Regards,

Family Member is EU route, your not on that so no chance there.

The only way is the pain of the Schengen visa application.

Can you not naturalise immediately after ILR being a spouse if you've been here three or five years depending on date?

Hi Wanderer, didn't know you could, been in the UK for 10 years now, been married for 6 months. I assumed my only naturalisation option is after completing one year on my ILR (LR)

On what basis have you applied for ILR? It's only via the spouse route that you can possibly gain ILR and Naturalise at the same time.

ILR based on Long Residence, unfortunately. Don't think we have been married long enough to go down the route you've suggested :)

you may apply for naturalisation now subject to meeting residence requirements and other standard criterion.
as spouse of a british citizen you dont need to wait for 12 month and it doesnt matter the route you have used to obtained ILR

Thanks for your reply ban.s, I did not know this. Are you able to point me in the right direction to investigate this further? Perhaps a link to the UKBA website that explains this?
