which visa for love?

which visa for love?

hello

ME(Alison,44,Bristish) and my Partner(26,Indian) have been living togther for 3 years ,we have a gorgeous 2 year old boy,my boy friend is presently on student visa doing his masters in cell pathology(which is under shortage skill profession list),the issue is i am out of work since i had the baby, i used to work for animal rescue centre & i have many rescued animals (which makes it difficult for me to go live in a different country) :? , we live in house that is owned by my sister.
so if we apply for his stay to home office on the basis of civil partnership
*does me being out of my job effect the application?
*will they consider his employability which is good as a positive?
*is it better to get married and then apply for spouse visa?
*is the difference in our age a cause for concern? 8)
secondly..he has just applied for his extension on 31st march,exactly on the day of his expiry will that have any implication on his extension.

You can't get a civil partnership - they're for same-sex couples.

I think u might struggle to get any sort of visa for him if you can't support him.

I don't see what having cared for animals has to do with living in a different country but it shouldn't come to that anyway, ur priority is acquire a source of income.

So, here's what you do:

1. Find a job or source of income. His employabilty won't count now since it's now the HO will be interested in. He can work on Student visa up to 20 hrs. If ur not working how r u managing? If ur on benefits I think ur task is next to impossible.

2. Make sure u've got accommodation and there is a proper room - u know u must have but the HO will assume ur living the hallway or sth unless u prove it.

3. Age diff is no problem

4. More worrying is his extension, does he have proof he posted it BEFORE the expiry date? Like registered letter etc. If he posted it on same day of expiry without any proof I aren't think what might happen and the HO dispute it. I know the HO have been leniet to some with a small gap but they seem to be tightening up everywhere now.

*with regards to my source of income ..does it matter if its a full time or part time employment for me
*house -- yes there is plenty of room as it is just me and bf ,my sis has a bungalow of her own...she owns two houses ..i dont pay any rent on the house i live in.(sorry,i should have made it clear in the earlier post)
*he has all his documents right and he is from a good university,just wondering if the same day posting will classify him as a overstayer.

If ur working, earning, showing ur not spiralling into poverty and u have a place to live then u should be fine.

Thing is to PROVE it, not just accept they will know, provide bank statements, wage slips, P60s, letter from ur sister saying u can live rent free, assume nothing, prove everything.

Overdo the whole thing and have an answer for any objection.

But why did he leave his visa extension so late? That was just daft, gives our cynical Gov a reason, but don't worry, many here have missed there;s but a week or two so no need to panic but have an answer ready just in case.

if he is working that fine i know lot of people in the same situation and has been successful the home will only consider is income and if you get a third party sponsor that even better good luck

How strong is the proof of co-habitation that you have for the unmarried partner's visa(UPV)? If not strong enough, then marriage might be the way forward. Otherwise the UPV should be the call.

thanks for the reply 'docterror' ..strange name!...anyways we have been together since jan 2004 and we got tons bills , registration with the local gp etc..what are other documentary evidence can i provide...


and yep im aware that third party income is no longer considered
