Curtailemnt Letter

Post by Harry438 » Tue Feb 17, 2015 1:45 pm

Hi Guys,

I have quick question, i am on a tier 2 general and got redundant in November 2014 and haven't received curtailment letter. after speaking with my solicitor she suggested to write a letter to HO (curtailment team) and request them to send the curtailment letter which i did 2 weeks back and now i called HO recently to make sure they received my letter and in return they informed that they have send the letter to my address and i'll be receiving it soon. I doubt i have is will i get 60 days or will it be less than that to apply under new sponsor.

Forgot to mention, i do have a new sponsor which is going through RLMT and will be finished by this month. The reason am worrying is because its almost gonna be 4 months since I've left my last employer and am thinking coz of that HO will reduce the leave to less than 60 days. Is that correct or am i panicking for no reason ?

TIA

i dont understand why a solicitor will advise to request a curtailment letter.
Anyway, u dont need to worry, the 60 days limit is from the date of issue of letter by ukvi.

@iworker: Thanks for the reply, so you mean to say that even though i've passed 4 months after redundant and my old employer informing HO as soon i left the job, i still will get 60 days when i receive the letter which will be in a day or two or will it be different like 5 days or 28 days. Its just i've read something like that somewhere but not read it completely what it was for that's why am panicking. Do you think when i receive the letter it will be 60 days or will it be something else. Sorry to ask you silly questions but its just the nerves because am soon applying under new employer and dont want to miss out on that.

Thanks !

@Harry438
No need to worry about. If you have not received the letter, it is absolutely alright. Now a days, HO is taking more time to issue the letter. As per guideline, it says HO will issue after 28 days once your employer informed them about your termination, but i don't think they do.

In fact, I, myself, applied after 70 days of my previous termination and got my VISA within 4 weeks time. But soon you apply for VISA, it's always good. So, don't wait for letter from HO, apply for VISA immediately if you already have COS from new employer.
Hope that helps. All the best.

@ravisb_2014: Thanks for your input, well when i called HO today they said they have posted the letter to me today by which i think i'll get it by tomorrow, my only worry is will the letter say i have 60 days from the date they post the letter or less days keeping in mind that i'll have been made redundant almost 4 months back. I do have new employer but will be applying by end of this month as waiting for RLMT to finish.

The letter would mention the date of issue and the curtailment is 60 days from the date of issue.
