Discretionary Leave To Remain

Hi everyone! I need help on this topic. I was granted Discretionary Leave To Remain for 2.5 years as a formal asylum seeker on the grounds of my British partner and her children. After the grant the relationship became unstable and we have separated and moved on. I am now in a relationship with my partner who is an EU national. Prior to the time I met her, she was working but last September, 2014, she enrolled to study full time course and stop working. We are planning to get married in April. My Leave To Remain is due to expire in a few months.

What are the requirements? Or is there a big problem here when it is time to extend my stay?

Are you working at present?

You may not qualify under the DLR policy anymore, although it would have been quicker for you in terms of ILR.

You can only success under the Regulations, if your partner is exercising treaty rights or you have a leave to remain which permits you to work, and she currently have employment.

She was working until last September when she decided to go to university on a full time studies. My partner had children from a formal relationship. I do have permit to work and study. I am currently working full time and at the same time studying part-time.

You may qualify under the regulations, if you can demonstrate a durable relationship.

Hi guys! Home office is investigating all marriages that involves one or non-eu partners. The registrar must refer all propose marriage or civil partnership to the home office(including sec24/24A is the registrar suspect anything. What are the factors they consider to investigate the couple.
