Single claim of working tax credits

Post by Carling40 » Thu Feb 19, 2015 6:29 pm

Hi i'd be grateful for some advice, does claiming working tax credit for a year as a single person affect ability to acquire permanent residence?
I am a non-eea national with an EEA2 residence card issued in 2010 and expires in 2015. I have been working all the way through till date.
my EEA spouse has been working since 2009 till date. however we've been having problems in our marriage in 2013 and she wasn't staying at home at the time i applied for the working tax credits, i the non- eea claimed working tax credit for about a year.
We are still married as of date but likely to start divorce proceedings soon.
My question is, will the fact that i made a single claim of working tax credit affect my permanent residence application after divorce?
she is very uncooperative i must add and i really have tried to make this relationship work.

Hi,

My question is why did you make the claim when you're still a dependent under your EEA spouse?Besides you're still married.
My humble advice will be whenever you're making your application for PR do not include anything that will show your claim as these may against you if the case worker finds out, lucky may be on your side as long as you have full 5yrs treaty right of your wife that's what they always kin to see and not your if you're still married.Good luck
It is really good to help and everyone deserve to be respected in life. Good luck.

Hi wise thanks for the comments, we were separated as she left home for while and hindsight is a beautiful thing. My previous posts will give you an idea of my marital issues but 2 years on we are still trying to save our marriage, that's why am thinking should it not work out what the implication if any will be. The current application form requests for that information albeit the claim was 2 years ago!. More advises from moderators and gurus is welcome. Thanks
