VERY URGENT!! Someone Please Respond

Dear all,

Warm regards. Hope all of you are keeping well. Can someone kindly say how could I apply for a Tier 4 to Tier 2(General) visa switching without the CoS number before my present T4 Visa ends? My company has requested for an allocation from UKBA, but haven't heard anything yet even after continuous calls and urgent e-mail. My present Visa ends on Feb 28th.

What is the best possible solution for me to get the Tier 2 (General) visa?

You can apply without the CoS stating that the Sponsor - quote their licence number, is awaiting further unrestricted COS allocation. It is simple as that, once you get a COS inform the caseworker. You are best to do a paper application as it takes more time for the application. This gives you more time for the Sponsor to get their allocation.

Thank you very much for the response Frontier Mole.

Just an hour back, my company got the allocation mail from HO. My HR will be working on the SMS to provide me the CoS. Later, I plan to apply for the Premium Service.

A quick question- My earlier VISA application was refused by HO as my role did'nt fit the NQF6. So, my HR is changing my SOC code with a new Job title and also increased salary. Will this create any issues to my new application? HR plans to give me a letter stating my new role and salary as well.However, is it mandatory to have the exact Job title mentioned under occupation lists for the SOC code? I believe the SOC code is the one which matters?

The new application will get treated as just that. If the SOC and salary requirements are met then all should be fine.
It is for the Sponsor to defend their position if they get a visit in the future.
The circumstances will attract more attention than a brand new no previous history application.
I am assuming you are a UK degree graduate that is exempt from the RLMT?

Yes, I am a recent Project Management graduate from the UK and been working with the company for last 5 months.
So, i take from you that it will be treated as fresh new application and there won't be any check of my previous VISA application.

The SOC for me which my company is putting has Related Job titles as Project Manager as seen in the NQF6 occupation list. My HR plans to put the job title as Junior Project Manager under the same SOC code. Is that fine??

Have no illusion that your previous refusal will go unnoticed that is not the case. It just means that you will not be automatically refused because of it.
The Sponsor can give you any job title they want as long as the job meets the SOC. Being a junior anything is still a person doing the role but just lower down the pecking order.

Just to be on a safer side, I will carry the new Letter (say Promotion Letter) with New Job Title and revised salary in case the caseworker checks my earlier application. I hope that must be fine.

And i understood SOC matters, job title can be anything as long as it fits the job description.

My advice is NOT to present any promotion letter etc as that will fuel any suspicion.
It is a common error trying to use a NQF4 role SOC, leave it as it is. It was an error by your Sponsor not you so there is no need to produce paperwork for your Sponsors benefit.
Keep it simple and if asked say what it is an error. If they query further then let them talk to the Sponsor to explain. Do not get involved as it all points to you not having a a real vacancy etc.
