SOC 2000 and SOC 2010 Codes(Unique and interesting confusion

Post by bholo » Wed Feb 25, 2015 8:25 pm

Guys,

Ok A very unique problem. When i got my First tier 2 i believe my employers was still able to use SOC 2000 codes because when you print a summary it shows the job type and i have my old copy of COS and it shows job type SOC 2132: Software professionals.

I applied in 2012 by the way and i got the visa. 2132 is a 2000 code which further splits to 2136,2135 and 2139. I didnt saw 2136 anywhere on my COS.

Anyway now i am looking for a new job in same company which falls more closely to 2135. Do i need a change of employment ? I personally think no because of the BITS IN BRACKET IN POINT 1

1: You must also make a change of employment application if you are remaining with the same employer but:
 there is a change to your core duties which means you change jobs and the new job is in a different Standard Occupational Classification (SOC) code to the one stated on your CoS. (This does not apply if the SOC Code for your new job has only changed because of the reclassification from SOC 2000 to SOC 2010.); or

2: A change of employment application is not required for other changes to your job. For example if:
 you are remaining with the same employer and change jobs to a different job within the same SOC code,

Do i need a change of employment application , i am confused but personally thinnk no.

If the answer is no , then because my employer is same, i shall be simply sending my extension with a new job title.

Can some one please advice.

Does this answers my Questions

If a Sponsor assigns a Certificate of Sponsorship before 6th April 2013, the old Codes of Practice,
salary thresholds and advertising criteria will continue to apply. This is the case whether or not the
individual Tier 2 applicant makes their application before, on or after 6th April.
The new Codes of Practice, salary thresholds and advertising criteria will apply to all applications
relying on Certificates of Sponsorship assigned by Sponsors on or after 6th April.
Sponsors who have been allocated Restricted Certificates of Sponsorship before this date will be
unable to change the details from SOC 2000 to SOC 2010. They must assign those Restricted
Certificates of Sponsorship to migrants before 6th April or they will be lost,
