Hi guys! Could you advise me on the following:
The sponsor I found decided to open a new department and offered me a job there. (I've never had a Tier 2 visa before)
About 2 weeks ago our restricted CoS application got rejected because according to the HO we chose the wrong SOC code and the salary was wrong as the employer stated the salary for the new entrants whereas now we know that I’m qualified only as experienced.
We placed 2 new adverts choosing another SOC code (not the one we used and not the one HO suggested) as the duties now match this new code as it’s a different role. What the employer intends to do:
- Apply under this new SOC code that matches the new adverts
- State the experienced salary according to this SOC code
- Apply for the restricted certificate on the 29th day from the date the new adverts were placed
However HO now usually asks for the name of the suitable candidate even before assigning CoS and the employer already mentioned my name in the last application for the CoS.
What employer would like to do:
1) Explain HO that even though now they are offering a different role in the same new department (it’s a very specific new department) that I’m still the only person that meets all the requirements even for the new role (I applied for the new adverts as well).
2) The employer also would like to ask for urgent Restricted CoS because the company has been looking for a person for this new department for about 4-5 months and is suffering, although the positions offered were different.
How do you think what the chances are for getting the restricted CoS and getting it urgently?
Maybe someone applied for urgent consideration and could share their story as we need to know if they usually visit the company in this case or ask for additional documents apart from the screen shots of the adverts and the contract of employment.
I would appreciate any advice.
