Canadian marrying british citizen

Post by joshsmith » Tue Mar 03, 2015 5:06 pm

Hello

I am a Canadian citizen marrying a British citizen this summer. The wedding is taking place in Canada and we are moving to the UK right after the wedding. We are trying to figure out what my best options are for a visa and it all seems so complicated. Right now I am considering just applying for the Tier 5 Youth Mobility Visa as it seems like the most straightforward option. Once I am in the UK, I figure I can switch to a different type of visa. Does anybody have any advice in this regard? Are there any other options I should consider? Thanks so much. Just trying to sort out a very complicated process...

Why don't you apply for a Spouse visa after the wedding? The requirements to switch from Tier 5 to spouse from within the UK will be the same.

That makes sense, but according to the "policy guidance" on the Tier 5 youth mobility Visa , "Switching into any other Points-Based System route or into visitor status is not allowed."
Does that not mean that they would NOT be able to switch from Tier 5 to spousal visa?

'Points-based system and visitor visas'. Spouse visa applications don't come within either of these categories. Under current regulations a switch to spouse from Tier-5 is permitted.
