Hello Everyone,

Need advice urgently , brief detail of my Case is as following.

Came here as a student , completed all my education Got two Masters Degrees.

then Married to EU citizen two years ago.

Submit on time EEA2 application.

home office refused my application as they cannot confirm employment of my wife stating they cannot find employer on yell.com and therefore this employment is not genuine.

Provided them pay slips , bank statements , and HMRC record that tax been paid of the said employment to review there decision. But all in vain .

last year submitted another application . Call us for interview after four months . Got wrong few questions and they refused my application again.

The interviewer attitude was very rude and he tried all his best and used all his dirty techniques to make us confuse and he was successful in that. Asked questions like two years before events , birthdays , christmas , etc

The main aim of the interview is not to find a genuine relationship but to make the applicants confuse and make them say wrong answers. Even you say i forgot that then he will give you options like this and that. The whole process of EEA 2 application is a joke now. They don't care of EU laws of which they are part of it and getting benefits form the wider economy of EU.

Then submit appeal in first tier tribunal . The judge was a part time judge, means he/she was practising immigration lawyer ( guess how can he/she manage both profession and not mingle up) . The presenting officer was i believe now better than my lawyer. The judge ignored all our evidence and relied on the original interview and dismissed my appeal with no sympathetic consideration.

As our marriage is genuine without any doubt and i am willing to pursue my case in all courts and Drag the home office in higher courts to get justice and prove that the interview is not enough procedure to prove someone marriage.

My question is how far can i go can i go to high court after upper tribunal and then go to court of appeal and then to supreme court
and then to ECHR. Because my marriage is Genuine and i have no fear of anything, why should i accept the lovey and unfair decision of Home office.
I will be thankful to anyone honest advice .

That is precisely the tricks these days. I thought it was confined to my client alone, but it appears it was widespread.

My client was asked questions on when he shared his first kiss with his wife? and when his spouse last prayed, questions that are bounds to give different answer, what time did he and his wife slept last night.

On the basis of those 3 inconsistent answers, he was refused, but thankfully he was successful in his appeal today, so yes you need to file an appeal, as it is a waste of time applying for reconsideration in Marriage of Convenience cases.

Depending on your location in the country, you may get a hearing soon.
