28 days Validity!!!

Hi all,

I recently lost my final appeal on an EEA dependancy application and permission to further appeals refused. Does the 28 days of leave apply to me to make submit a fresh (any) application or do i automatically become an overstayer. Pls I need an urgent reply as I have been served papers as an overstayer but not detained because I am married to a British citizen.
