two applications at the same time

1. I have an application with the HO under the fact that a have british born children which is been pending for over 6 months now. The HO requested for their passport which I cannot get because their mother and myself cannot get along. At present I'm in court trying to get court order for contact to them and thats taking forever to sort out.

2. I am presently divorced from EAA and I wish to put in another application as my 5years visa expired. At present, I can not work, it is really tough and I'm owed for work done and my former employer holding on to my pay until my visa is renewed.

3. Do I put in this second application so that I can work and earn a decent living. HELP

On what basis are you considering the other application?

You are permitted to make another application.

Dear Obie,

Thanks for responding to my enquiry.

Your question as to on what basis are my considering the other application?

My answer: My other application will be on the basis of retention of a right of residence following divorce or annulment of marriage to an EEA family member as my EX1 application has hit a snag, as I could not provide my children passports and court papers for contact as requested for by the caseworker for the EX1 application.

What do I do now?

Have you evidence of you ex wife's treaty right at the time of divorce .

Do you play any role in the life of your child?

Yes to both questions.

Q1. She was self employed up to the the period of divorce.

Q2. I have PR on my children, my name on their BC, pays CSA, not upto date, cause of unresolved dispute about calculations.

What do I do?

Need to seeK legal advice.

I believe you could reasonably qualify on the basis of both, depending on the qualify of the evidence you have.
