Naturalisation Residence Requirement

Post by SRIEI52 » Tue Mar 24, 2015 1:29 pm

Hello,

could somebody clarify under following case is my wife eligible to apply UK naturalisation as a British Citizen on 30 March 2015
Came to UK : 29 April 2009
ILR: 30 Sep 2013
Last 3 years absence 278
Last 5 years absences 394
Husband British citizen on 20 Jan 2015
married from 7 years

our worry is under 5 year residence rule total absences 394 in last 5 years is well within allowed 450 days so okay but as she also spouse of British Citizen from 20 Jan this year would she be seen under 3years residence rule then total absences in last 3 years is 278 that is more than allowed 270 days? would this cause any problem?

thanks

Interesting case.
You're only 8 days above the limit so personally I would apply on and ask for discretion.
But I'd await more replies.
Being British is a state of mind.
