Difficulty with spouse visa

Post by jonidorian » Fri Mar 27, 2015 6:19 pm

Hi,
I'm a British citizen, studying an UG degree in Norwich. I'm currently studying in America for the year, coming back to the UK in July. I’m getting married to my fiancé in the US in May hopefully, and we both want him to come back to England with me, where we will live together. This entitles him to a spouse visa so he can work here, but he doesn’t meet the financial requirement of the visa just based off his yearly income (his last financial year was $25,839 approx conversion being £17356, £1000ish short of the financial requirement). But this is based purely off his yearly income, and not taking into consideration the money he will get from family, tax returns, and money in small claims through the local court, which would definitely bring him above the threshold. This also doesn’t take into account my student loan (my income at this moment is currently very low, because I’ve only worked weekend jobs or no jobs at all.) Where on earth do we stand? how does it look for a UK resident student with a spouse applying for a visa to be in England for up to 2 years? (as I do not intend to be in England for more than 2 years before moving back to America with him.) Would he avoid the financial requirement if we married in the UK? Any and all help would be appreciated. Thank you.

You've misunderstood the rules. The financial income level is based on your UK earnings as the British sponsor. Your fiance's income won't be taken into consideration. Marrying in the UK won't change anything.

Lorraine47, you've highjacked another member's thread and your query bears no relation to the subject here. With respect, please start your own thread.
