Dear All,

I am planning to apply for my wife and child 1 year 2 months old for dependent visa. I have ILR. I am bit confused what kind of flat I will have to show.

Could you please advise me if I can show a studio or 1 bedroom flat?. Or it should be 2 bedroom?. I am really confused with the overcrowding manual. Since my daughter has passed 1 year of age Home Office will consider her half a person.

Could someone please help me?

You would need a 2 bedroom property.

Under the guidelines of the Housing Act (by which the UKVI assess overcrowding) a studio flat will be sufficient as long as the living/sleeping area is not under 50 square feet. The bathroom and k i t c h e n areas will not be included in the calculation. Your child isn't required to have their own room until they reach the age of 10.

I thought that was only the case if siblings of the opposite sex were sharing? If their baby was under 1 then yes...
Legislation says children aged 1-10 years are considered as 0.5 person and that 1 room is for 2 people and 2 rooms for up to 3. So as a family of 2.5 wouldn't a studio be considered as overcrowding?

Another option would be using 1 bed living room as an additional room to reduce costs.

I will then show a two bedroom flat. Documents wise do I have to also provide council survey report along with tenency agreement ?

u also need to show financial requirement and for your mrs A1 english language. R u earning £22400 or more?

Yes I am earning 26k plus. I am just gathering 6 months payslip. Also my wife has already passed KET test at A1 in 2013.

Any other details will be appreciated.
