Switch to Tier 2 General visa from Dependent visa

Post by askaquestion » Wed Apr 08, 2015 11:15 pm

Hello!

Me and my wife are both on ICT Tier 2 Long term visa.

Her project is coming to an end and she is switching over as my dependent ( Tier 2 ICT Long term --> Dependent visa )

Question:
1. Once she is in the UK as my dependent, can she switch from dependent visa to Tier 2 General visa to be employed by a UK based company? For instance: Can her current company process her Tier 2 General visa?

Regards,
V

She may switch to being your dependant in the UK.
However, she cannot switch from a dependant to Tier 2 (General) in the UK as 245HD(b) fails. Moreover, if she applies for entry clearance, then she is also subject to 245HB(g), etc.
