Hi I am working as a software developer on a permanent contract based and I got my tier 2 general visa from 20/1/2014 to 20/4/2017 and my soc code was 2137.

Recently I have seen the rule sating that

Tier 2 (General) and Tier 2 (Sportsperson) migrants wishing to apply for indefinite leave to remain will have to demonstrate that they are receiving either a gross salary of £35,000 per year or the appropriate amount for their job as set out in the Codes of Practice, which are published on the UK Border Agency website. Tier 2 (Sportsperson) migrants will also have to provide evidence from their employer to demonstrate that they meet the new minimum pay threshold.

There will be an exemption from the £35,000 minimum pay threshold for migrants who are sponsored in a job listed either on the PhD-level occupation list or the shortage occupation list at any point during the migrant’s sponsored employment. Such migrants will still need to meet the salary requirements published in the Codes of Practice for their particular job.


currently my salary is 23300£ p/a and I do get 1000 pounds increment per year so am I eligible for ILR after my second extension ie
from 20/4/2017 to 20/4/2019 as Experienced worker salary for soc 2137 is £23,400.

I have seen latest soc codes in the link given below

Hi Mancy,
My question is that Am I eligible for ILR after my second extension having salary(around 28,300£ p/a) which less than the threshold salary(35,800£p/a) required for ILR..

The salary has to meet at the time of applying ILR. If your salary is less than £35K at time of applying then it will be rejected.

tip: Its always good to improve your skill set and aim for a 35k job by the time you apply for ILR.
