Need advise regarding spouse visa application

Hi friends I need advise regarding spouse visa. My application for tier1 was refused with right of appeal. I lodged appeal in the meanwhile I got married with my british girlfriend
We are living together last 8 month we met all requirements. My hearing date for tier1 is in July. Can I withdraw my appeal and apply for spouse visa? If I withdraw my appeal I will consider overstay? What you suggest me to do ?Please advise me thanks
