Tier 2 General Dependant Extension - FLR (M)or PBS Dep?

Tier 2 General Dependant Extension - FLR (M)or PBS Dep?

Hi,

I am currently in UK as Tier -2 general Dependant visa which expires on Oct 15th 2015. I am only 13 Month in UK until today.

And My husband currently in ILR through PBS Tier 2(General).

My husband Visa details:

Tier -2 General (Visa date):13/08/2009 - 01/10/2012

Tier -2 extension (visa date): 03/09/2012 - 15-10-2015

ILR - (visa date) - 23/03/2015


My Visa details: visa granted date: 01/12/2013

Entry date into UK: 23/03/2014

Expiry date:15/10/2015

I do not qualify for the ILR - Because I got the entry clearance visa after July 2012 and will not complete qualifying 5 year residential period.


Please advise on which visa do I have to extend my stay (PBS Tier 2 Dependent Visa or FLR (M)) ?

- If I’m proceed with PBS tier 2 dependant, is that possible to make two extension application?

If i’m Proceed with FLR(M) , i’m not complete 2 year permitted stay with my husband!
if i’m switch to FLR(M) i’ll reset the 5 year qualifying period.I really don't mind FLR-M reset the ILR qualifying period because i’m only looking easier way to apply without hassle.


I'm meeting requirements for both applications.

1. we have funds maintained 695 for more than 90 days period.

2. I have English Language (B1 SELT) requirement proof

3. Income proof from my husband - more than £18,600.


When I check in UKVI https://www.gov.uk/remain-in-uk-family/exceptions, they said If your partner was in the UK on a temporary visa before settling or becoming a British citizen, you may have to apply as a ‘dependant’ (partner) in their original visa category. according to this I have to use PBS Dependant.


But PBS is more expensive than FLR, SO IF I can use FLR-M I would prefer this .


But according to forums FLR-M also OK, But When I called UKVI they telling that I should use PBS Dep form.


So , I'm confused PBS dependent or FLR -M ??


Any help is greatly appreciated. Please can anybody advice me?

Question 1
I planing apply for FLR(M) but i'm not sure whether i'm eligible for FLR(M) because i'm only 14 month in UK as a dependant visa.

Question 2
i cannot provide six items for address prove because i'm do not cover the 2-year period.

Question 3
FLR-M 07/2014 guidelines they mentioned that You must not use this form to make an application
for an extension of stay in the following categories:
• As the partner of a person granted indefinite leave to remain in a work route, if you are currently in the UK as their dependant. See our

If you go for FLR(m) , you will start the clock again towards ILR. The 14 months you already spent as PBS Dependent will not be counted.

You path to ILR will be delayed by 14 months.

I'm quite happy if I'm delayed 14th Month, hopefully i could get double extension on my FLR(m). Is that I'm eligible for FLR(M) in my current condition? because i'm only 14th month in UK but on requirement has to be 2 years in UK with prove address,. correct me if i'm wrong.

Any help is greatly appreciated. Please can anybody advice me?
