Visa Extension

Hi

I need advice on below query,

I was issued Tier 2 General Visa in June 2012 and i reallocated to UK in same month, but i left UK at the end of April 2013. I came back to UK on same visa in the month of December 2013 and currently staying in UK,

1. As i am due for my visa extension, will be there any issue due to gap (6 Months) and i am currently working with same employer who had issues my COS earlier ?

2. Will i be applicable for ILR after 2017? (My current employer will renew my visa for max 2 years more)

3. Can i switch job before or after my visa renewal? Can my new employer provide me new COS and can i use new COS for my visa extension now?

Help will be much appreciated

1. yes with new cos. no rlmt needed if in same role.

2 depends on how many days exactly were u out for

3 yes at any time with a new cos. If changing employer, the new empolyer will need rlmt with unrestricted cos.

for point 3 - ( Currently my visa is expiring on 26th June, can my my new employer provide new COS now so that i can extend my visa with new employer not with old employer??)

the new employer can issue a cos at any time. However in order to apply within UK, it has to be before your current leave expires.

For guidance as to how to make the switch, follow the guidance (this is IMHO)

Get offer from new company.
agree on start date (suggest keep it 3 months in future)
they will need to carry out rlmt
Ask them to issue cos
apply for visa
new visa granted
resign from current job
serve your notice ( you will be allowed to work till start date of new visa which will be agreed start date with new employer)
join new company
