Job title change on Tier2 ICT Visa

Hi,

I am in UK since 2011 on Tier 2 ICT visa under the rules in place before 06.04.2011 and current Tier 2 ICT visa valid until 01.05.2016 (extended 2 years). I recently received a job offer within the company from different department which is a great opportunity for me.

I would like to know if I change my role & position and department within the company would this situation have impact for my Tier 2 ICT visa extension next year ?

Should I re-apply the work permit visa?

AS I know I am eligible for apply ILR Visa after 10 years without cooling off period , should I work for the same position for 10 years with the same sponsor?

if your SOC code in the new role will be different from what it is at present then you will need a new CoS and, once you have it, apply for a variation of your leave to remain. You cannot start in the new role before you have the new leave, so it may be best to use the premium service.

My current CoS code is 2423 , and I will do very similar job but as a Manager in different department. In that case I think i am safe to accept the offer , am I right?

Current Job type: 2423 Management consultants and business analysts
Current Job title: Senior Statistic Office Analyst

New title : Business Intelligence Manager (Logistics)

job title less important than the job description which has to be a good match with what is in the SOC code.

The choice of SOC code is the sponsor's responsibility, not yours

It seems impossible to get promotion or transfer to an other department with Tier 2 ICT Visa Type , please see follow;

Technical changes of employment
If during the validity of the work permit, you wish to amend the personal
details of your employee or make minor changes to the information we hold,
you should complete a Notification of Technical Change of employment form
To be considered as a technical change of employment, the UK Border
Agency need to be satisfied that the individual will continue to work under the
same terms and conditions and continue to meet the work permit criteria. Any
significant changes to location, salary, level of job or working hours are not
considered as technical changes and will be regarded as a change of
employment. Significant changes to the job, location or terms and conditions
will require a new application under the points-based system.


Examples of changes we will not accept as a technical change

The permit holder’s duties have changed due to promotion, demotion or restructuring.
The permit holder’s salary has risen significantly; that is above normal annual increments or pay awards applied to all, or most, staff.
