I Called HO about Naturalisation or PR

I Called HO about Naturalisation or PR

Hi all members

I called Home Office this afternoon to get more informations about Naturalisation if I should apply for PR or for naturalisation.

I told Home office.

1.Arrived in UK as a spouse of EU citizens in 2010. But when I arrived my wife already had PR.
2.I did Applied for RC and I got it will expire March 2016
3. My Wife became British citizen in April 2012.

Home office personal told me that I can apply under British citizen spouse because my wife is British citizens now and I have been living in country since 2010. She said that I don’t to need to wait for 5 years. Because under spouse of a British citizen only need 3 years of marriage.
She asked me how long I have been married I told her six years but I married outside of the UK. And I arrived in UK in 2010. She told me I can apply for naturalisation.

I want know if she is right or she gave me wrong information? Can I apply now for naturalisation?

As so often happens with the Home Office advice line, the information is misleading.
Although the 3 year rule remains for those married to a BC, both the EEA and UK regulations now require 5 year residence before qualifying for PR or ILR. As permanent residence is mandatory before being able to apply for British Citizenship, you'll need to have completed the full 5 years before applying. Once you reach the 5 year period (which presumably is this year) you will be able to submit your BC application assuming you meet the standard requirements. You must ensure that you were physically in the UK 3 years previous to the date of application.

But sometimes is confusing when the situation changed. Like in my case that my wife is British citizen now.
I got RC and if I can avoid to apply for PR and go straight for BC then it's better.

Filling that PR form is crazy some many pages. in my case when I arrived in country my wife already had PR.

If I apply for PR! Do I need to provide evidences for treaty rights of my wife or just her PR card?
