Switching from Tier 2 ICT to Tier 2 General

Team,

I had / have following UK Work Permit / Visa for the validity period mentioned below with same employer for the past 5+ years. I am currently staying in UK under Tier 2 ICT Long Term Migrant visa (with salary range above 40k GBP pa)

24-Sep-2008 to 24-Sep-2010 - Visa Work Permit (stayed 2 yrs in UK)
25-Sep-2010 to 24-Feb-2011 - No UK Visa was staying in India
24-Feb-2011 to 28-Feb-2013 - Visa Tier 2 (ICT) Established staff (stayed 3+ months in UK and most of the duration in India)
28-Feb-2013 to 15-Dec-2013 - No UK Visa was staying in India
15-Dec-2013 to 14-Jan-2014 - Visa Tier 2 ICT Long term staff migrant (staying for the past 1 month and planned to stay for 2yrs in UK).

I am planning to transfer the sponsor now, could you please let me know if i am eligible for switching from "Tier 2 ICT Long term staff migrant" to "Tier 2 General" in UK?

unfortunately you cannot switch from T2 ICT to T2G because you had entry clearance since your T2 ICT Established Staff leave

Hi,

My spouse is currently working for Health Care industry on Tier 2 ICT dependent visa. Her employer is willing to sponsor for Tier 2 General. In that case can she change in UK or she has to move out of UK? Is there any change in cooling off period applicable with new changes effective April-2015?

she can only apply from home country with a restricted CoS. The job has to be NQF level 6 or a shortage occupation. No cooling off.

Thanks for the information. For the restricted CoS mentioned should my spouse employer should initiate a request or individuals can initiate the request?

only the employer can apply for restricted CoS (provided they are T2G registered sponsors)[/
