Switching from Family visitor to Elderly dependent visa.

Post by imk1 » Mon May 11, 2015 2:00 pm

Hi

I am on ILR.
My parents are in the UK on family visitor visa, Can they apply to switch into Elderly dependent visa category from within the UK?

Thanks

Nope. In-country switching from visit visa was blocked years ago, plus this visa is impossible to get and is very expensive, designed to promote failure since UK immigration policy does not want chain migration.

Also after the rejection means no visit visa will be granted as an intention to settle has been demonstrated so think twice about going down this doomed route.

Wanderer is correct. Apart from not being able to switch from visitor visa to any other category, unless you can prove the following mandatory requirements, an application for an Elderly Dependent visa will fail and any future visitor visa applications are likely to be refused.: From the UKVI guidance:
You must prove that:
you need long-term care to do everyday personal and household tasks
the care you need is not available or affordable in the country you live in

the person you’ll be joining in the UK will be able to support, accommodate and care for you without claiming public funds for at least 5 years
you’re 18 or over

This also has to apply to both parents. This route has tightened to the extent that very few applications have been approved since the rules changed. The argument would be that if you can afford the daily care that both would need in the UK then it would be affordable in their own country.
