Indefinite leave to remain after Tier 2 sponsorship

Post by megwanderer » Mon May 11, 2015 11:34 am

I currently have a Tier 2 sponsorship visa. My visa has been renewed this year and finishes end of next year when I can apply for my Indefinite Leave To Remain. I have two questions I need help with:

1. My job is no longer on the shortages list. If I were to change employers but continue doing the same job I was originally sponsored for, is it possible to just switch my visa over to a new employer or will I have to re-apply for the Tier 2 (obviously having a problem as my job is no longer on the list)?

2. Assuming it's ok to switch employers and them taking on my visa will this affect my application for my Indefinite Leave To Remain? Will I still be able to apply end of next year or will I have to start my 5 year process again?

ANY help on this would be wonderful as I'm having serious trouble finding any answers!

you'll have to make a change of employment application and if the job is no longer on the shortage occupation list the new sponsor will have to carry out an RLMT before assigning the CoS

switching sponsor will not affect the 5 year qualifying period but make sure the new sponsor is prepared to certify that they need you for the job in question when the time comes for the ILR application next year. Some sponsors are reluctant to do so because once you have ILR you are no longer tied to them.
