Returning to the UK with a 5 years residence card.

Post by agetl » Tue May 12, 2015 5:47 pm

Hi,

I've been trying to find someone with the following scenario:

Husband married EEA Citizen that was living in the UK and exercising Treaty Right.

Husband applies for an EEA Family permit which was approved so they start living in the UK.

Husband applies for a Residence Card for 5 years which is approved.

After two years, husband and wife moves out of the UK (to another British territory though: Cayman Islands). For a 2 years contract job.

After the two year have passed, family intends to come back to the UK.

Can husband use the 'Residence Card' without problem? I know that you are considered resident of the UK if you spend there at least 6 month every year. However, this won't be met which possibly makes the RC invalid (but, how do they know? I don't think they track all of this on their systems).

What is the best thing to do, or if you happen to know someone that has been in this situation, what was the outcome?

Regards
